1. The Store fulfills orders within the territory of Poland.
2. Placing an order in the Store constitutes acceptance of the provisions of these Terms and Conditions.
3. The store offers upholstered furniture for bedrooms, living rooms, guest rooms, etc., as well as custom-made furniture.
Customer Registration
4. The Customer is obliged to fill out the "registration form" in accordance with the facts. The Customer completes the registration form. A properly completed registration form requires filling in all fields marked with an asterisk. After filling out the form, the Customer proceeds through all stages of the order. Incorrectly completed order forms will not be considered.
Acceptance and Fulfillments of Orders
5. Placing an order shall be understood as filling out the "order form" located on the store's pages. After receiving the order, the store's IT system automatically generates an email confirming acceptance of the order, which is sent to the email address specified in the order form. The order is registered in the store's IT system.
6. A natural person placing an order must be at least 18 years old and have full legal capacity. In the case of minors, the consent of a parent or guardian is required.
7. The Seller reserves the right to withdraw from fulfilling the order if the data provided by the Buyer in the form is incomplete; providing a contact email address and a telephone number will facilitate the resolution of any concerns regarding the order.
Prices, Deliveries, Payment Methods
8. Prices of goods in the Online Store's offer are expressed in Polish Zlotys and include VAT. The stated prices also include shipping costs.
9. The cost of shipping is included in the price.
10. The Seller undertakes to confirm the order with the Buyer via the Internet or telephone within 24 hours of receiving the order. This time may be extended if it falls on days recognized as non-working days (Sundays and public holidays). If within 24 hours from placing the order, the order cannot be confirmed, the contract does not come into effect. In the event of discrepancy in the provided data, we reserve the right to refuse to fulfill the order, about which the ordering party will be informed immediately.
11. Order fulfillment times range from 10-15 days; any extensions of the delivery date will be agreed upon individually with the Buyer.
12. Each purchase transaction will be confirmed by an invoice.
13. The order will be executed immediately after the payment is credited to the Seller's account. The ordered goods, along with the confirmation of the conclusion of the contract, are delivered to the Customer in the manner specified by the Customer when placing the order.
14. An order may be canceled by the Customer via email or fax, no later than on the day of dispatch of the ordered goods.
15. For the ordered goods, the Customer has the option to make payment as follows:
cash on delivery (payment upon receipt of the shipment)
by bank transfer to the account specified on the VAT invoice after receiving prior approval for the bank transfer
Right of Withdrawal
16. Consumer's right to withdraw from the contract:
We inform you that in accordance with the "Act on Consumer Rights" of May 30, 2014, Journal of Laws 2014, item 827, you have the consumer right to withdraw from the contract within 14 days of receiving the purchased item. The consumer may withdraw from the contract without giving any reason. To meet the statutory deadline for withdrawal from the contract, it is sufficient to send information regarding the exercise of the Consumer's right of withdrawal before the expiry of the withdrawal period. To withdraw from the contract, you must submit an appropriate unequivocal statement to the Seller, sending it by post to the address: S&G Home Grzegorz Chmura ul. Dworska 80 33-206 Luszowice or by electronic mail to the email address: sghome@onet.pl. The Consumer may use the sample withdrawal form provided below, but it is not mandatory.
In the event of withdrawal from the contract, all payments received from the Consumer will be reimbursed immediately, including the costs of delivery (except for additional costs resulting from the method of delivery chosen by the Consumer other than the cheapest standard delivery method offered by us), and in any case no later than 14 days from the day on which we were informed of your decision to exercise the right of withdrawal from the contract. We will reimburse the payment using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any case, you will not incur any fees as a result of this reimbursement.
The costs of returning the goods are borne by the Consumer.

No right of withdrawal:
The right of withdrawal from the contract does not apply to the Consumer in respect of contracts:
• for the provision of services, if the entrepreneur has fully performed the service with the express consent of the consumer, who was informed before the start of the performance that after the performance of the service by the entrepreneur, they will lose the right to withdraw from the contract;
• in which the price or remuneration depends on fluctuations in the financial market over which the entrepreneur exercises no control, and which may occur before the expiry of the deadline to withdraw from the contract;
• in which the subject of the performance is a non-prefabricated item, manufactured according to the consumer's specifications or serving to satisfy their individualized needs;
• in which the subject of the performance is an item subject to rapid deterioration or having a short shelf life;
• in which the subject of the performance is an item delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery;
• in which the subject of the performance are items which, after delivery, due to their nature, become inseparably mixed with other items;
• in which the subject of the performance are alcoholic beverages, the price of which was agreed upon at the conclusion of the sales contract, and the delivery of which can only take place after 30 days and the value of which depends on market fluctuations over which the entrepreneur has no control;
• in which the consumer has expressly requested the entrepreneur to come to them for urgent repair or maintenance; if the entrepreneur additionally provides other services than those requested by the consumer, or delivers items other than spare parts necessary to perform the repair or maintenance, the consumer has the right to withdraw from the contract in respect of additional services or items;
• in which the subject of the performance are audio or visual recordings or computer software delivered in a sealed package, if the package was opened after delivery;
• for the delivery of daily newspapers, periodicals or magazines, with the exception of a subscription contract;
• concluded via a public auction;
• for the provision of accommodation services other than for residential purposes, transport of goods, car rental, gastronomy, services related to leisure, entertainment, sports or cultural events, if the contract specifies the day or period of service provision;
• for the delivery of digital content which is not recorded on a tangible medium, if the performance has begun with the express consent of the consumer before the expiry of the deadline to withdraw from the contract and after being informed by the entrepreneur about the loss of the right to withdraw from the contract.
Complaints
17. The Buyer may submit complaints regarding the concluded Contract to the address: sghome@onet.pl or in writing to the Seller's address.
A properly submitted complaint should contain at least:
- name, surname, address, email address of the Buyer,
- the date of conclusion of the Contract constituting the basis for the complaint,
- the subject of the complaint, indicating the Buyer's request,
18. The Seller evaluates all complaints within 14 days from the date of receipt in its proper form. The response to the complaint is sent to the email address provided by the Buyer or to the traditional postal address. In the event of any missing information in the complaint, the Seller will inform the Customer about the need to complete it to the necessary extent within 7 days counting from the date the Customer receives the request.
Out-of-court Dispute Resolution and Claims Procedures
18. The Customer may use the following possibilities of out-of-court dispute resolution and claim settlement methods:
a) obtain assistance by using the free help of the appropriate municipal or district consumer ombudsman or social organizations, i.e., Consumers' Federation, www.federacja-konsumentow.org.pl/, helpline 800 889, Association of Polish Consumers, http://www.konsumenci.org/, helpline 800 889 866.
b) is entitled to submit a request to resolve the dispute to a permanent consumer arbitration court operating at the Trade Inspection.
c) is entitled to submit a request to initiate mediation proceedings to the Voivodeship Inspector of the Trade Inspection.
Final Provisions
19. Resolving potential disputes arising between the Seller and a Customer who is a Consumer within the meaning of Art. 22 of the Civil Code shall be submitted to the competent courts in accordance with the provisions of the Code of Civil Procedure. Resolving potential disputes arising between the Seller and a Customer who is not a consumer within the meaning of Art. 22 of the Civil Code shall be submitted to the court having jurisdiction over the seat of the Seller.
20. The content of these Terms and Conditions may change, and the Customer will be informed about any amendments through information on the main page of the store containing details about the changes and the date of their entry into force, which date will not be shorter than 14 days from the date the changes are announced.
21. The Seller reserves the right to change the unit prices of the goods in the store's offer. The price change will not apply to orders already accepted for execution. The Seller also reserves the right to withdraw selected goods from the offer.
